Without a will, state law determines who receives your assets, according to Bridgette Wilson, a lawyer with Busch, Zurbuch and Thompson.
Wilson advises that anyone age 18 or older complete a will, especially those with children or more than one marriage.
The guardian of a child can be established with a will and potentially prevent an argument, she explained.
If a re-married individual does not name their spouse as the beneficiary, assets could go to children. For example, if the husband had children from a prior marriage and the wife is not named to receive the property or money, it could go to the children only, Wilson explained.
