Student Busted for Growing Marijuana

A Davis & Elkins College student is lodged in Tygart Valley Regional Jail after the Elkins Police Department searched his dorm room and found a setup for manufacturing marijuana.

According to the criminal complaint provided by the EPD, the D&E security detail received an anonymous e-mail referencing drug activity in room 142 of Presidential Hall. The dean of students and security requested police presence to enter the room. Elkins police officers told the security officers they could not enter the room. However, Kenneth David McCartney Jr., 19, of Montross, Va., was present and gave police permission for the police to come inside.

"Once inside, a small set up of manufacturing marijuana was noted under the defendant's bed," the report states. "Seven marijuana plants were being raised inside a plastic container with a grow light on top."

Police also found a scale, rolling papers, baggies, several bongs and pipes in the room. Inside a blue glass, police found several germinating marijuana seeds. According to the complaint, McCartney showed police where most of the items were located.

The report states, "After the items were collected, the defendant was placed under arrest for manufacturing a controlled substance ... While police were at the department, a sample was taken from one of the bongs and tested with a Narcotics Analysis Reagent Kit No. 8 ... and the test was positive for marijuana. One or more of the plants may be sent to a Charleston lab for testing upon request of the prosecutor."

Sgt. E.R. Canfield and Patrolman S.R. Judy are the investigating officers. According to Capt. J.E. Batdorf, McCartney will be arraigned today in Randolph County Magistrate Court.

Comment #2, I forgot one aspect of this young man's character, he is honest to a fault. He didn't try to shirk the resposnibility. As the article states, he allowed the authorities into his room and showed them what they were looking for, he was caught and he faced up to the consequences. If you notice they didn't find any other illegal drugs,firearms or wads of cash lying around which is what you WILL find in the dwelling of a drug "kingpin" or even a common dealer. In a way he is smart for trying to grow his own because the chemicals that dealers and distributors put on marijuana these days can be lethal. I am not condoning or praising him for using drugs, but merely understanding the safety and economics of growing your own. There are great contributors in our society who used marijuana in their college days who weren't caught and had their lives destroyed. Whomever reported this should be ashamed and maybe focus on REAL criminals if they want to contribute to soci

This young man is just one of millions of kids who are in college and "using" marijuana. Using is the key word here. Anyone who believes that germinating 6 seeds is a starter kit for a drug "kingpin" is a complete idiot unlike this young man who is just a regular idiot for first trying to grow plants in his dorm room, of all places, and second for associating with people who are not his friend and dropped a dime on him for doing so. This is obviously a jealous girlfriend or someone that doesn't like him because he is popular. I know KD and he is all the nice things that the other people who know him wrote. He is kind, considerate, witty, cordial and above all RESPECTFUL. Who he was harming in this case is exactly one person; himself, which every individual in the United States has the wright to do, if they do it legally. To label him as a drug dealer or a criminal is incorrect. If anything he is guilty of posession of a controlled substance and drug parapher

I know this young man, and he's a heck of a kid. I question whether the story played out as written, but regardless, I sure hope his friends -- young and old -- will come out & support him like he'd ABSOLUTELY do for them.

audyhaze, I'm not going to tell you AGAIN that an arrest/seizure like the one described in this article is NOT TRUE GOOD POLICE WORK!! It's a follow-up at best. It's the cops getting an anonymous call and following up on it! THERE WAS NO IN DEPTH INVESTIGATION!

I know Kenny personally, and he never deserved this. Sure, he's dumb as hell, but he's such a nice guy. He's talented and caring. He's always there for his friends. It's horrible that his life is so messed up now. He wanted to be a teacher, but I don't see that happening. Marijuana is no reason for someone's life to be ruined like this.

Oh how much safer we all must feel now that this "terrible & violent" criminal has been safely put behind bars!

Gimme a break. Laws are meant to protect society. But marijuana laws do more harm to society than the use of the drug itself.

And to the above poster, audyhaze, there is no such thing as a marijuana "kingpin". It's grown & sold almost everywhere, and used by an estimated 1 in 10 people. Probably even by people you know.

Wow, this is a shame and you can bet this student's academic career is over especially at D&E. Further, I wonder if not more have participated. It is wonderful that law enforcement is "weeding" out these law breakers and blight to society and Randolph County. I salute the police (all) for being vigilant and catching these types. It is hopeful that you catch the "kingpins" and follow the sales trail down to the lowest user. As Judge Judy said, "don't pee on my leg and call it rain".. this is true good police work.
