Barbour grand jury returns 29 indictments
By BEN SIMMONS, Staff WriterA Barbour County grand jury handed up 29 indictments Tuesday including 21 sealed arrest warrants. Among those indicted was a Belington man accused of growing marijuana.
Charles M. Hutzler, Route 3, Box 58A, Belington, was charged with one count of manufacturing a controlled substance, a felony. According to the indictment, Hutzler is accused of cultivating marijuana on April 27.
Therese M. Black, 117 S. Main St., Philippi, was charged with one count of grand larceny, a felony. According to the indictment, Black is accused of taking a washer, dryer, Sony DVD player, bedroom suite, RCA flat screen television and other items having a value in excess of $1,000 from John J. Conley.
Ronald F. Fagons, Route 1, Box 394, Moatsville, was charged with one count of receiving stolen property, a felony. According to the indictment, Fagons is accused of receiving more than $1,000 worth of multiple items from an unknown individual and which were stolen from Bertha Newman.
Frederick A. Canary, Route 1, Box 133-A, Belington, was charged with one felony count of third offense driving while under the influence of alcohol and one misdemeanor count of first offense driving while license suspended or revoked for driving under the influence of alcohol. Canary is accused of driving under the influence on April 26 and has two prior DUI convictions.
Matthew S. Collins, 99 1/2 Fourth St., Stonewood, was charged with one count of breaking and entering, a felony. According to the indictment, Collins is accused of breaking and entering a building owned by William M. Compton on March 16.
Jeffrey S. Everson and Lindsey D. Walsh, both of Main Street, apartment 3, Philippi, were each charged with one count of grand larceny, a felony. According to the indictment, Everson and Walsh are accused of taking a 1987 Ford Ranger truck belonging to Nathan M. Hampton in January.
Thomas A. Bennett, 11 Hinkle Drive, Buckhannon, was charged with one count of grand larceny, a felony. According to the indictment, Bennett is accused of taking a 1986 Ford Bronco from Jack and Kelli Raines on Dec. 19, 2008.
Arraignments will be conducted at 9 a.m. Thursday at the Barbour County Courthouse before Circuit Judge Alan D. Moats. Barbour County Prosecuting Attorney E. Lynn Phillips will present the state's cases. All defendants are innocent until proven guilty.
