Several arrested in Upshur County thefts, fraud

By Gary Mallonee, Staff Writer
POSTED: October 12, 2009

A string of recent ATV and dirt bike thefts throughout Upshur County resulted in the arrest of one man and a pending arrest of another.

Howard Joseph Landers, 18, of Buckhannon was arrested on Wednesday and charged with two counts of grand larceny, a felony, and two counts of receiving and transferring stolen property, a misdemeanor, according to the report filed in the Upshur County magistrate office.

On Sept. 25, Landers allegedly stole a 2003 Suzuki Train Bike and a 2005 Suzuki Ozark four-wheeler valued at $4,000 from a residence at Adrian.

Landers also allegedly was in possession of a 2008 Yamaha Dirt Bike valued at $900, knowing that it had been stolen. The incident was investigated by Trooper S.C. Baier with the Buckhannon Detachment of the West Virginia State Police.

The Upshur County Sheriff's Department is also investigating Landers for allegedly stealing a Yamaha 350 from a residence near Sago. The Yamaha was valued at $1,200 and was traded for a pickup truck at a residence on Brushy Fork.

On Oct. 1, while questioning Landers about the theft, Baier noticed a bike matching the description of a 2005 Honda that was reported stolen from a French Creek residence.

Landers was arraigned before Upshur County Magistrate J. Michael Coffman who set bond at $40,000. If convicted, he faces one to 10 years in prison and a fine up to $2,500 on each count of grand larceny and up to one year in jail and a fine of $2,500 for receiving/transferring stolen property on both counts. Landers remains in the Tygart Valley Regional Jail.

Brenda Lee Shaw, 30, of 126 Bakers Run, Sutton, is currently in the Tygart Valley Jail on a $25,000 bond after she was arrested and charged with allegedly obtaining property under false pretenses.

According to the report, Shaw allegedly obtained goods or services from another individual by writing two personal checks, one in the amount of $600 and the other for $420. According to BB&T Bank records, Shaw no longer had a checking account at that bank.

Shaw was arraigned before Upshur County Magistrate Juanita Adams. If convicted, she faces one to 10 years in prison and a fine up to $2,500 on each of two counts.

The incident was investigated by Lt. Mark Davis of the Upshur County Sheriff's Department.

Cpl. Troy Brady III also received a complaint that between Aug. 27 and Sept. 7 Shaw allegedly wrote 17 checks at the Brushy Fork Mart totaling $447.40.

Shaw had three different addresses, including one in Buckhannon, Sutton and Gassaway, listed on the files at the magistrate clerk's office.
