Man charged with domestic battery

A Junior man faces a felony charge of domestic battery.

According to the criminal complaint at the Barbour County Magistrate Court, this is the third offense for Robert Eugene Smith, 54, of 108 Row St., in regard to domestic battery. Smith was convicted of domestic battery, second offense, on Feb. 19, 2008, according to the criminal complaint.

The complaint alleges that around July 31, Smith returned to his home after an evening of drinking. He then allegedly started yelling at the female victim and went out to the front porch. The victim allegedly locked the front door after he went outside.

Smith then allegedly broke the window in the front door and entered the residence, where he reportedly grabbed the woman, threw her to the kitchen floor and hit her in the head, the complaint stated.

The Barbour County Emergency Medical Squad was contacted when state troopers observed that the victim was bleeding. According to police, she injured her hand on broken glass while trying to keep Smith out and the door locked.

Smith first appeared before a magistrate Aug. 1 and was released on a $10,000 personal recognizance bond. He is scheduled to appear at 10:30 a.m. today in Magistrate Court for a preliminary hearing.
