Upshur teacher faces 15 years for sexual assault

A former Upshur County school teacher will face up to 15 years in prison when he is sentenced next month on three counts of third-degree sexual assault.

Thomas Brian Lamb, 49, of Buckhannon, entered into a plea agreement Friday in Upshur County Circuit Court, agreeing to waive his right to grand jury proceedings and to plead guilty to a bill of information containing the three charges. He will be required to register as a sexual offender for the remainder of his life, according to the terms of the agreement. He must also forfeit his teaching certificate. He had previously worked as a teacher at Buckhannon Academy Elementary School, but resigned following his arrest last month.

Each count carries a prison sentence of up to five years, and Prosecutor Jake Reger recommended that at least two of the sentences run concurrently, while the other sentence would be served consecutive to the first two.

The prosecutor also agreed not to pursue any further charges regarding the victim in this case, said to be a 15-year-old girl, and the incidents were alleged to have occurred in December 2010 and November 2011.

Lamb's attorney, Thomas Prall, requested a pre-sentence investigation be completed prior to sentencing.
