Upshur couple arraigned on underage sex charges

A pre-trial conference for a Buckhannon couple charged in a six-count indictment on sexually related charges in which they are alleged to have gotten a teenaged girl drunk and photographing her in explicit acts will be held at 9 a.m. July 17.

Timothy Allen Sargent, 42, of Route 1, Box 180B, French Creek, and Rachel Nicole Sargent, 25, of 89 Sago Road, Buckhannon, were each indicted on three counts of conspiracy and single counts each of permitting, using, persuading, inducing, enticing or coercing a minor to engage in sexually explicit conduct, photographing a minor engaging in sexually explicit conduct, and the using of a minor to produce sexually explicit material.

Both are being held in the Tygart Valley Regional Jail. Timothy Sargent is being held on a $100,000 bond, while Rachel Sargent is being held on a $75,000 bond. Upshur County Prosecuting Attorney Jacob Reger said the the Sargents were married at the time of their arrest.

According to the criminal complaint filed in Upshur County Magistrate Court following their arrest in January, the Sargents are accused of giving a 16-year-old girl alcohol to the point she is reported to have passed out. The complaint stated that Timothy Sargent engaged in sexual intercourse in a Buckhannon motel, and that Rachel Sargent took photographs.

Senior-status Judge John Henning said jury selection for their trials will be held at 9 a.m. July 23. Their trial will be conducted at some point between July 24 and Aug. 2, Henning said.

A pre-trial conference will be held at 9 a.m., July 17 for Edward Matthew Williams, 27, of Route 4, Box 456A, Buckhannon, on felony charges of burglary, grand larceny, breaking and entering, two counts of child neglect creating the risk of serious bodily injury and misdemeanor charges of discharging a firearm within 500 feet of a dwelling, destruction of property and petit larceny.

Williams was arrested on Jan. 25 following a stand-off with state troopers just off of West Virginia Route 20. According to court records, Williams is alleged to have broken into two houses, ransacking one and removing firearms. He allegedly threatened the occupant of one house and took that person's truck, loading his two children into it.

Williams is under home confinement, and Henning granted Williams' request to be able to leave the residence to attend work and Narcotics Anonymous meetings. But Henning denied Williams' request to be able to attend a birthday party for one of his children.

Jury selection for Williams' trial will be held on July 23. Henning said the trial will be set for some time between July 24 and Aug. 2.

Jury selection will be held July 23 for the others indicted last week by the grand jury. Those include:

- Thomas Lee Casto, 36, of 7 Marjorie Ann Drive, Buckhannon, on a felony charge of domestic battery-third or subsequent offense and misdemeanor charges of being a prohibited person possessing a firearm and two counts of driving under the influence of alcohol-first offense. He is being held in the regional jail in lieu of a $75,000 bond.

- Chris Lee Howes, no age or address listed in the indictment, had a $5,000 personal recognizance bond set on a charge of failing to provide support to a minor.

- Sherry Marie Ramirez, no age or address listed in the indictment, was ordered not to operate a motor vehicle as part of her bond condition after being indicted on a charge of DUI-third or subsequent offense.

- Bruce Wayne Hicks, 43, of 269 Featherbed Road, Walkersville, remains in custody after being indicted on three counts of the fraudulent use of an access device and one count each of burglary and grand larceny.

- Dustin Joel Mills, 25, of Route 1, Box 163F, French Creek, is free on bond after being indicted in separate matters on five felony counts of breaking and entering, three felony counts of grand larceny, a single felony count of conspiracy and misdemeanor charges of conspiracy and petit larceny.

- Rodney A. Harper, 25, of Route 4, Box 615A, Buckhannon, is free on a $30,000 bond after being indicted on a felony charge of breaking and entering and misdemeanor charges of petit larceny and conspiracy.

- Troy Anthony Cook, no age or address listed in the indictment, is free on bond after being indicted on a felony grand larceny charge.

- Bond was set at $5,000 for Scott Isaac Freeman, no age or address listed in the indictment, following his indictment on a felony charge of fraudulent schemes.

- Inisia Marina Moore, no age or address listed in the indictment, is free on bond after being indicted on 28 counts of the fraudulent use of an access device.

- Bond was set at $5,000 personal recognizance for Ashley Lantz, no age or address listed in the indictment, who was indicted on 24 counts of obtaining a controlled substance by misrepresentation, fraud, forgery, deception or subterfuge. She was not represented by an attorney at her arraignment, telling the judge she was searching for one to take her case.

- Todd Vincent Lee, 19, of Route 4, Box 621A, Buckhannon, is free on bond after being indicted on 31 counts of forgery and 30 counts of uttering.

- Colton Lee Foster, 19, of HC 36, Box 103, Buckhannon, is being held on a $25,000 cash/surety bond after being indicted on two felony counts of burglary and a misdemeanor charge of petit larceny.

- Roger L. Tiffner II, no age or address listed in the indictment, was indicted on a felony charge of unlawful assault.

- Ashley L. Bailey, 25, of 1836 U.S. Highway 33, Weston, is free on a $20,000 bond after being indicted on two counts of breaking and entering and two counts of conspiracy.

- Tonya S. Montgomery, 37, of 4 Norvell Drive, Buckhannon, is free on bond after being indicted on two counts of breaking and entering and two counts of conspiracy.

- Robert H. Sprouse Jr., no age or address listed in the indictment, was ordered to not operate a motor vehicle as part of his bond condition after being indicted on a felony charge of driving while having a license revoked for DUI-third or subsequent offense.

- Kayla Ranee Golden, 22, of 840 Left Laurel Lick Road, Weston, is free on bond after being indicted on six counts each of the fraudulent use of an access device and conspiracy. A co-defendant, Travis Wayne McQuain, of 347 Liggett Addition, Buckhannon, was indicted on the same charges, and his arraignment was continued to a later time after he failed to appear for the morning session of court.

- Bond was set at $2,500 personal recognizance and $2,500 cash/surety for Joseph R. Loudin, no age or address listed in the indictment, after he was indicted on a felony charge of unlawful assault. He was ordered to have no contact with the alleged victim in the case.

- Barbara J. Starkey, 55, of Route 6, Box 208B, Buckhannon, was ordered not to operate a motor vehicle as part of her bond conditions after being indicted on a charge of DUI-third or subsequent offense.

- Walter Lee Grimmett, 59, of 78 Renny's Mobile Home, had his arraignment continued to a later time after he was not available for the morning session of court. He was indicted on a felony charge of DUI-third or subsequent offense and a misdemeanor charge of driving while license revoked for DUI-second offense.

- Joseph Arthur Wood, 39, of Route 1, Box 296, Buckhannon, was ordered not to operate a motor vehicle as part of his bond conditions after being indicted on a felony charge of DUI-third or subsequent offense and a misdemeanor charge of driving while having a license revoked for DUI-first offense.
