Lewis enters guilty plea to a felony charge in Circuit Court

ELKINS — A Barbour County man, whose traffic stop last year led to a chase on foot and a police officer allegedly being kicked and head-butted, took a plea deal on Monday in Randolph County Circuit Court.

Nathan Mark Lewis, 40, of Belington, pleaded guilty to one count of driving revoked for DUI-third offense, which is a felony, and one count of misdemeanor battery of an officer.

Lewis was initially charged with possession with intent to deliver, obstructing and attempting to disarm an officer and driving revoked for DUI-third offense.

With the DUI-third offense, Lewis could be sentenced to one to three years in prison and face a mandatory fine of $3,000 to $5,000. The misdemeanor battery of an officer charge could see Lewis sentenced for 30 days to one year and being fined up to $500. The sentences could possibly be served consecutively.

Lewis is currently being held in the Tygart Valley Regional Jail on a $50,000 cash-only bond.

The case was prosecuted by Assistant Randolph County Prosecutor Richard Shryock. Lewis was represented by Attorney Steve Nanners.

Circuit Court Judge David Wilmoth presided Monday. At one point during the hearing, Wilmoth asked Lewis if he attempted to take an officer’s gun away from him during the 2023 altercation.

“No, I did not try to grab the gun,” Lewis told the court. “I did head-butt him.”

Lewis will be sentenced on Dec. 16 at 1:30 p.m.

According to the initial criminal complaint, on Dec. 7, 2023, at approximately 9:53 p.m., Patrolman J.H. White, of the Elkins Police Department, conducted a traffic stop on a Saab on Goff Street due to a registration light being out and an expired registration.

The driver, Lewis, was “visibly shaking” while speaking to the officer, and said he’d lost his license, the complaint states. He also allegedly identified himself using several false names, and a false date of birth.

White detained Lewis and began to search the vehicle, finding baggies containing substances that appeared to be fentanyl and methamphetamine, and a digital scale, the complaint states.

At this point, Lewis ran from the traffic stop, “through multiple yards, eventually ending in a backyard behind Auto Zone,” according to the complaint.

White caught up to Lewis, who then “began fighting the officer while in handcuffs,” the complaint states. Lewis “then kicked and head-butted the officer multiple times.”

“During the altercation the subject grabbed the officer’s firearm and was able to take the hood off the holster in an attempt to withdraw the officer’s service firearm from the officer’s holster,” the complaint states.

White was “able to gain compliance” and walk Lewis back to the traffic stop, according to the complaint.
