Simmons sentenced to up to 20 years

ELKINS — A Randolph County man was sentenced this week on felony convictions for incest and sexual assault by a parent, guardian or custodian.

Brandon Lee Simmons, 39, was sentenced in Randolph County Circuit Court Tuesday to five to 15 years in prison for the incest conviction, and 10 to 20 years in prison for the sexual assault by a parent, guardian or custodian conviction.

Simmons was also sentenced to 35 years of sex offender supervision after he is released.

He is currently being held in the Tygart Valley Regional Jail.

The case was prosecuted by a special prosecutor, Upshur County Assistant Prosecuting Attorney R. Miriah Mills.

Randolph County 911 received a call on May 18, 2022 about an alleged sexual assault, according to the 2022 criminal complaint.

The caller advised Randolph County Sheriff Deputy J.L. Wolfe that her daughter’s friend had told her she had been sexually assaulted.

The complaint states the alleged victim gave the caller a written statement detailing the sexual assault.

In February 2023, Simmons was indicted by a Randolph County grand jury on four counts each of incest and sexual abuse by a parent, guardian or custodian.
